These Terms of Service ("Terms") form a legally binding agreement between VYPN AG ("VYPN", "we", "us") and you, governing your use of the VYPN VPN application and the website at www.vypn.net (together, the "Service"). Please read them before using the Service. If you do not agree, do not use the Service.
1. The Service
VYPN is a virtual private network (VPN) application. It encrypts your internet connection using the WireGuard® protocol and offers optional DNS-based content filtering (for example ads, trackers, and malware). The Service can be used without a user account; an optional account lets you manage your subscription across devices. We do not log your VPN traffic, as described in our Privacy Policy.
VYPN Premium is a paid, auto-renewing subscription that removes the free usage limits. Purchases made in the iOS app are billed through your Apple account: renewal, cancellation and refunds are handled by Apple, and you can cancel at any time in your App Store subscription settings. Deleting your VYPN account does not cancel a subscription purchased through the App Store – cancel it in your App Store settings. Purchases made on our website are billed by us and can be managed in your account on the website. The price and term are shown before every purchase.
2. Acceptable use
You agree to use the Service only for lawful purposes. In particular, you must not use the Service to:
- break any applicable law or infringe the rights of others;
- attack, disrupt, or gain unauthorised access to any network, system, or account (for example scanning, intrusion, denial-of-service, or distributing malware);
- send spam or other abusive bulk traffic;
- resell or commercially redistribute the Service without our written permission.
You are responsible for how you use the protected connection.
3. Availability
We work to keep the Service available and performant but provide it "as is" and "as available". We do not guarantee uninterrupted or error-free operation and may change, suspend, or discontinue parts of the Service at any time. Your internet access and device remain your responsibility.
4. Limitation of liability
To the fullest extent permitted by law, VYPN is not liable for indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service. Nothing in these Terms limits liability that cannot be limited under Swiss law.
5. Intellectual property
The Service – including the VYPN application, website, trademarks, and software – is owned by VYPN and protected by law. These Terms grant you a limited, non-exclusive, non-transferable licence to use the app for its intended purpose. WireGuard is a registered trademark of Jason A. Donenfeld.
6. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or use the Service unlawfully.
7. Changes
We may update these Terms from time to time. Material changes take effect when the updated Terms are published. Continued use of the Service after changes means you accept them.
8. Governing law
These Terms are governed by the laws of Switzerland. The exclusive place of jurisdiction is Zug, Switzerland, subject to any mandatory consumer-protection rules of your country of residence.
9. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy, form the entire agreement between you and VYPN regarding the Service.
